The Feldman Firm, LLC Files Amici Brief in Support of Pennsylvania’s and New Jersey’s Action to Block Changes to ACA Contraception Mandate

The Feldman Firm, LLC is proud to serve as local counsel to the U.S. Women’s Chamber of Commerce (www.uswcc.org) and the National Association for Female Executives (www.nafe.com) in their capacity as Amici Curiae in Commonwealth of Pennsylvania v. Trump, et al., a lawsuit brought by the Commonwealth of Pennsylvania and the State of New Jersey seeking to block proposed Trump administration rules that would allow employers to opt out of providing health insurance coverage for contraception if they oppose its use on moral or religious grounds.

On January 7, 2019, The Feldman Firm, LLC, along with Leah R. Bruno, Esq. of Dentons US LLP, which serves as primary counsel for USWCC and NAFE in litigation involving the contraceptive mandate of the Affordable Care Act, filed a Brief in support of Pennsylvania’s and New Jersey’s requested relief.

On January 14, 2019, U.S. District Judge Wendy Beetlestone of the U.S. District Court for the Eastern District of Pennsylvania granted a nationwide preliminary injunction blocking the proposed new rules, and filed a detailed opinion supporting the injunction. As a result of this successful injunction action, the contraceptive mandate in the Affordable Care Act remains unchanged. The matter is now the subject of an appeal to the U.S. Court of Appeals for the Third Circuit.

  1. Litigating claims involving the sale of a business;

  2. Litigating claims for breach of contract and promissory estoppel;

  3. Litigating claims between members of LLCs for breach of their businesses’ operating agreements and related tort claims;

  4. Litigating and negotiating objections to an accounting filed by the trustees of a charitable trust on behalf of a beneficiary of that trust;

  5. Litigating the breach of a settlement agreement;

  6. Litigating claims for fraud, breach of warranty, breach of a non-disclosure agreement, and tortious interference with contract claims in relation to purchased industrial equipment and related services;

  7. Litigating a real estate easement claim;

  8. Litigating a widow’s claim to liquidate investments made by her late husband;

  9. Issuing and serving Pennsylvania subpoenas based on out-of-state actions, and addressing compliance issues regarding those subpoenas;

  16. Advising members of businesses regarding offers to purchase their interest in their business and discharge their personal guarantees of their business’s debt;

  18. Negotiating a severance agreement for an executive being laid off from his company;

  19. Advising lenders on Small Business Administration (SBA) regulatory compliance issues related to the liquidation of loan collateral;

  21. Representing homeowners in preparing an offer to subdivide and purchase a neighboring residential property.

The Feldman Firm, LLC is celebrating #GivingTuesday and the holiday season by making contributions to three charitable organizations:  Sara’s Smiles Foundation, the Southern Poverty Law Center, and the National Greyhound Adoption Program.  Sara’s Smiles (www.saras-smiles.org), based in Meadowbrook, Pennsylvania, honors the memory of Sara Kate Burke, Jeff Feldman’s niece, by brightening the spirits of pediatric cancer patients in hospitals and care facilities around the country. The SPLC (www.splcenter.org), is a national civil rights organization based in Montgomery, Alabama that promotes tolerance and seeks justice for the most vulnerable members of society.  NGAP (www.ngap.org), based in Philadelphia, PA, helps find adoptive homes for former racing greyhounds, including the Firm’s very own official mascot, Sundae.  We wish everyone a meaningful #GivingTuesday and a peaceful and joyous holiday season.
